Refund Policy

FemmeKare is a telehealth service operated by SDKare LLC and is not a separate legal entity.

This Refund Policy explains when payments made directly to SDKare LLC for FemmeKare services may be eligible for a refund. It also outlines the conditions governing appointment cancellations, same-day appointments, late cancellations, no-shows, rescheduling, and applicable fees.

By scheduling and paying for a FemmeKare service, patients acknowledge the applicable refund and cancellation terms disclosed during the booking process.

Nothing in this Policy limits any rights or remedies available under applicable federal or state law.

1. Refunds Before a Scheduled Appointment

Patients who cancel an appointment at least 24 hours before its scheduled start time are eligible for a full refund of the applicable appointment service fee, except where a separately disclosed and legally permissible non-refundable booking condition applies.

Appointments canceled less than 24 hours before the scheduled start time are non-refundable. These appointments are considered late cancellations and may be rescheduled rather than refunded, subject to the conditions described in Section 3.

Same-day initial appointments are subject to the additional conditions described in Section 2.

To request a cancellation or refund, patients must contact FemmeKare Patient Support using the contact information provided in Section 10.

All refund decisions remain subject to applicable law.

2. Same-Day Appointments

Appointments booked by new patients for an initial consultation scheduled on the same calendar day are non-refundable.

The following conditions apply:

  • Same-day initial appointment payments are non-refundable when patients cancel or fail to attend.
  • Patients may request to reschedule rather than receive a refund.
  • One complimentary rescheduling opportunity is available for a qualifying same-day initial appointment.
  • The original appointment payment will be applied toward the rescheduled visit.
  • Patients should notify FemmeKare Patient Support immediately if they cannot attend.
  • A first qualifying late cancellation does not incur an additional $25 late-cancellation fee.
  • Subsequent qualifying late cancellations are subject to the $25 fee described in Section 3.
  • No additional $25 no-show fee will be charged for a non-refundable same-day initial appointment when the original payment has been retained.

This same-day booking restriction applies only to new patients scheduling their initial appointments. Existing patients are subject to the standard cancellation and refund provisions.

The non-refundable condition does not override any refund or other remedy required by applicable law, including circumstances in which FemmeKare fails to provide the purchased service.

3. Late Cancellations

A late cancellation occurs when a patient cancels an appointment less than 24 hours before its scheduled start time.

Late cancellations are tracked separately from no-shows.

3.1 First Late Cancellation

A patient’s first qualifying late cancellation is exempt from the $25 late-cancellation fee.

The original appointment payment is non-refundable. However, the patient may reschedule without an additional late-cancellation fee, and the original payment will be applied toward the rescheduled appointment.

The first-occurrence waiver removes only the $25 fee. It does not create a right to a refund.

This waiver applies unless one of the specific exceptions described in Section 5 applies.

3.2 Subsequent Late Cancellations

Any qualifying late cancellation after a patient’s first late cancellation is subject to a $25 fee.

The following conditions apply:

  • The original appointment payment is non-refundable.
  • The original payment will be applied toward the rescheduled visit.
  • The $25 late-cancellation fee must be paid before the appointment can be rescheduled, unless it has already been paid.
  • The $25 fee is a separate charge and is not deducted from a refund.

Patients should notify FemmeKare Patient Support as soon as possible when they need to cancel or reschedule an appointment.

All charges remain subject to applicable law and the terms disclosed before booking.

4. No-Shows

A no-show occurs when a patient fails to attend a scheduled appointment without providing the required cancellation notice.

4.1 First No-Show

A patient’s first qualifying no-show is eligible for one complimentary rescheduling opportunity.

No $25 no-show fee will be charged for the first qualifying occurrence.

The original appointment payment will be applied toward the rescheduled visit.

A complimentary rescheduling opportunity does not independently entitle the patient to a refund of the original appointment fee.

4.2 Subsequent No-Shows

Any subsequent qualifying no-show is generally subject to a $25 no-show fee.

The original appointment payment does not automatically become refundable because the patient missed the appointment.

The applicable fee is charged separately and is not deducted from a refund.

Any fee must be consistent with the terms disclosed to the patient and applicable law.

4.3 Exception for Same-Day Initial Appointments

When FemmeKare retains the original non-refundable payment for a same-day initial appointment, no additional $25 no-show fee will be charged for that missed appointment.

This exception takes precedence over the general subsequent no-show fee rule for the applicable appointment.

5. Separate Waivers and Special Cancellation Rules

5.1 Independent First-Occurrence Waivers

FemmeKare tracks no-shows and late cancellations separately.

Patients generally receive:

  • One first-occurrence no-show fee waiver.
  • One first-occurrence late-cancellation fee waiver.

These waivers are independent unless a specific exception described below applies.

A fee waiver does not automatically entitle a patient to a refund of the original appointment payment.

5.2 No-Show and Late Cancellation Within 24 Hours

If a patient has a no-show and a late cancellation within 24 hours of each other, only one first-occurrence waiver may be applied to those two events.

The waiver applies to whichever event occurred first.

The second event is subject to the applicable $25 fee, even if the patient would otherwise qualify for a separate first-occurrence waiver.

The exception prohibiting an additional no-show fee on a retained, non-refundable same-day initial appointment payment continues to apply.

5.3 Late Cancellation of a Rescheduled Initial Appointment

If a patient misses their initial appointment without notice, receives a complimentary rescheduling opportunity, and subsequently cancels the rescheduled appointment less than 24 hours before its scheduled start time, a $25 late-cancellation fee applies.

This specific exception applies even if the patient has not previously used their first-occurrence late-cancellation waiver.

The $25 fee must be paid before another appointment can be rescheduled, unless the applicable fee has already been paid.

The original appointment payment remains non-refundable and may be applied toward the rescheduled visit.

Any charge remains subject to the terms disclosed before purchase and applicable law.

5.4 Three Consecutive Appointment Cancellations

Patients who cancel appointments three consecutive times may have their scheduling arrangements reviewed, regardless of whether the cancellations were made within or outside the 24-hour cancellation window.

Following the review, FemmeKare may establish additional conditions for scheduling future appointments, provided those conditions are properly disclosed and legally permissible.

Any additional charge must be communicated to the patient before it applies.

This provision does not independently authorize an unspecified cancellation fee.

The standard $25 late-cancellation fee described in Section 3 continues to apply separately to qualifying late cancellations.

6. Refunds After Healthcare Services Have Been Provided

Appointment and consultation fees are generally non-refundable once the healthcare service has been provided, except where otherwise required by applicable law.

A service is considered provided when the scheduled consultation or appointment with the healthcare provider has taken place.

The appointment fee covers the healthcare provider’s professional time, clinical evaluation, and services provided during the consultation.

Payment for an appointment does not guarantee:

  • A particular diagnosis.
  • A specific treatment plan.
  • A prescription or medication refill.
  • A particular medication or medication change.
  • A referral.
  • A specific clinical outcome.

A provider’s determination that a prescription, medication, diagnostic test, referral, or other treatment is not clinically appropriate does not, by itself, make a completed consultation eligible for a refund.

Clinical decisions are made by the treating healthcare provider based on professional judgment, the patient’s medical information, applicable standards of care, and applicable law.

Any controlled substance prescribing restrictions, including refill intervals and medication changes, are governed by FemmeKare’s separate prescribing policies.

7. Appointments That Are Not Completed

If a scheduled healthcare service is not provided, refund eligibility will be determined based on the circumstances, applicable booking terms, and this Policy.

7.1 Appointments Canceled by FemmeKare or the Provider

If FemmeKare or the healthcare provider cancels an appointment before the purchased service is delivered, the patient may be offered an opportunity to reschedule or, where appropriate or legally required, receive a refund of the applicable appointment fee.

7.2 Technical or Operational Issues

If an appointment cannot be completed because of a technical or operational issue attributable to FemmeKare, patients should contact Patient Support so that the circumstances can be reviewed and an appropriate resolution provided.

Depending on the circumstances, this may include rescheduling, a refund, or another appropriate remedy.

7.3 Patient-Side Technical Difficulties

Technical difficulties experienced solely on a patient’s device, internet connection, or other equipment do not automatically create a right to a refund.

FemmeKare may review such situations individually, subject to the applicable booking terms and legal requirements.

The non-refundable appointment provisions do not eliminate refunds or other remedies required by law when the purchased healthcare service is not delivered.

8. Third-Party Charges

This Refund Policy applies to fees charged directly by SDKare LLC through FemmeKare.

Charges imposed directly by independent third parties, including pharmacies, laboratories, diagnostic facilities, and other healthcare service providers, may be subject to their own cancellation and refund policies.

Unless expressly stated otherwise at the time of purchase, FemmeKare does not control refunds for payments made directly to independent third parties.

Where a FemmeKare service or program expressly includes an additional product or service in the price paid to SDKare LLC, the refund terms disclosed for that service or program will apply, subject to applicable law.

9. Refund Processing

Approved refunds will be returned through the original payment method or otherwise processed in accordance with the payment arrangement used for the transaction.

Refunds apply to eligible cancellations made at least 24 hours before the scheduled appointment, as described in Section 1, and to other circumstances in which a refund is required or approved under this Policy or applicable law.

Late-cancellation and no-show fees are not deducted from refunds. Where applicable, these fees are assessed separately according to Sections 3, 4, and 5.

Appointments canceled less than 24 hours before their scheduled start time are not refundable under the standard cancellation terms. Instead, the original payment is applied toward a rescheduled visit where permitted by this Policy.

The time required for an approved refund to appear in a patient’s account may depend on the payment processor, financial institution, or card issuer and may be outside FemmeKare’s control.

FemmeKare does not guarantee a specific bank-posting timeframe after an approved refund has been submitted for processing.

Refunds required by law will be handled within any applicable mandatory timeframe.

10. How to Request a Cancellation or Refund

Cancellation and refund requests must be submitted to FemmeKare Patient Support by email.

Patients should provide sufficient information to locate their appointment or transaction, including:

  • Patient name.
  • Appointment date and time.
  • Email address or telephone number associated with the appointment.
  • Reason for the cancellation or refund request.
  • Relevant transaction details, where necessary.

For privacy and security, patients should not send detailed medical information, complete payment card numbers, or sensitive financial credentials through ordinary email.

Submitting a refund request does not guarantee approval. Requests will be reviewed according to this Policy, the applicable booking terms, the circumstances of the transaction, and applicable law.

11. Duplicate or Incorrect Charges

If a patient believes they were charged more than once for the same service or that a payment was processed incorrectly, they should contact FemmeKare Patient Support promptly.

Verified duplicate or erroneous charges will be corrected or refunded as appropriate.

Patients may be asked to provide reasonable transaction information to assist with the review.

Nothing in this section limits a patient’s right to any legally required payment correction or refund.

12. Charge Disputes

Patients who believe a charge is incorrect are encouraged to contact FemmeKare Patient Support so that the transaction can be reviewed and an attempt made to resolve the issue.

Patients retain any applicable right to dispute transactions through their financial institution, payment-card issuer, or another legally available process.

Nothing in this Policy restricts legally protected charge dispute rights or other available remedies.

13. Relationship to Other FemmeKare Policies

This Refund Policy should be read together with FemmeKare’s:

  • Terms and Conditions.
  • Payment Policy for Clients.
  • Patient No-Show and Late Cancellation Policy.
  • Applicable prescribing and telehealth consent policies.

Where a service has additional refund or cancellation terms lawfully disclosed before purchase, those terms may also apply.

Nothing in this Policy limits rights or remedies that cannot lawfully be waived under applicable federal or state law.

14. Changes to This Refund Policy

SDKare LLC may update this Refund Policy to reflect changes in FemmeKare services, operational procedures, or applicable legal requirements.

The Last Updated date at the beginning of this Policy identifies the most recent approved revision.

The refund and cancellation terms applicable to a transaction will be determined by the policy and terms disclosed to the patient in connection with that transaction, subject to applicable law.

Material changes will be communicated or implemented with any notice or consent required by law.
