Terms & Conditions
- Effective Date: October 12, 2026
- Last Updated: October 19, 2026
These Terms & Conditions (“Terms”) govern access to and use of the FemmeKare website, appointment scheduling, telehealth services, communications, payment services, and related features offered through FemmeKare.
FemmeKare is a telehealth service operated by SDKare LLC, which is the legal entity responsible for FemmeKare’s operations. FemmeKare is not a separate legal entity.
In these Terms, references to “FemmeKare,” “we,” “us,” or “our” mean SDKare LLC in connection with its FemmeKare services.
By accessing the website, creating an account, scheduling an appointment, making a payment, or using FemmeKare services, you agree to the applicable Terms and policies presented to you.
If you do not agree to these Terms, you should not use FemmeKare services.
Nothing in these Terms limits rights or protections that cannot lawfully be waived under applicable federal or state law.

By accessing or using FemmeKare services, you confirm that:
- You are at least 18 years old.
- The information you provide is accurate, current, and complete.
- You are using the services for yourself unless legally authorized to act on behalf of another individual.
- You will maintain accurate contact, billing, and health information.
- You will comply with applicable laws and these Terms.
Services are available only where FemmeKare has appropriately authorized healthcare providers and where telehealth services are legally and clinically appropriate.
FemmeKare may restrict access when information is materially inaccurate, incomplete, fraudulent, or inconsistent with applicable law.
3. Nature of FemmeKare Services
FemmeKare provides access to women’s healthcare services through telehealth.
Available services may include:
- Clinical evaluations and consultations.
- Treatment planning.
- Follow-up appointments.
- Medication management when clinically appropriate.
- Other healthcare services made available through FemmeKare.
The availability of any service depends on provider availability, professional licensure, patient location, clinical appropriateness, and applicable federal and state laws.
FemmeKare does not guarantee that every healthcare service, treatment, provider, medication, or appointment option will be available to every patient.
A healthcare provider may recommend in-person care or a different level of treatment when telehealth is not appropriate.
4. Clinical Care and Provider Independence
Clinical care is provided by licensed healthcare professionals exercising their independent professional judgment.
FemmeKare’s administrative and technology services do not direct healthcare providers to:
- Make a particular diagnosis.
- Prescribe a specific medication.
- Recommend a particular treatment.
- Order a specific test.
- Issue a referral.
- Guarantee a particular clinical outcome.
Clinical decisions are made by the treating provider based on the patient’s health information, clinical needs, applicable professional standards, and legal requirements.
Scheduling or paying for an appointment does not guarantee a diagnosis, prescription, medication refill, referral, treatment, or particular clinical outcome.
5. Provider-Patient Relationship
Visiting the FemmeKare website, accessing educational content, contacting Patient Support, or scheduling an appointment does not, by itself, establish a provider-patient relationship.
A provider-patient relationship is established when a licensed healthcare provider begins providing clinical care and applicable legal requirements for establishing that relationship have been satisfied.
Website content and administrative communications do not constitute individualized medical advice.
Administrative support personnel cannot independently diagnose medical conditions, prescribe medications, or determine treatment plans.
6. Telehealth Services and Informed Consent
FemmeKare provides access to healthcare services through telehealth, allowing patients to consult with licensed healthcare providers using electronic communication technologies, including video consultations.
By choosing to receive healthcare services through telehealth, patients acknowledge the nature, potential benefits, limitations, and risks of remote healthcare delivery.
6.1 Nature of Telehealth Services
Telehealth enables healthcare providers to evaluate symptoms, discuss medical concerns, develop treatment plans, provide follow-up care, and prescribe medications when clinically appropriate and legally permitted.
The availability of telehealth services depends on the patient’s physical location, provider licensure, clinical needs, and applicable federal and state laws.
Telehealth may not be appropriate for every medical condition or patient.
6.2 Potential Benefits of Telehealth
Telehealth may offer benefits such as:
- Convenient access to licensed healthcare providers.
- Reduced travel requirements.
- Access to healthcare from an appropriate private location.
- Easier scheduling of follow-up consultations.
- Continued communication regarding treatment and medication management.
These benefits are not guaranteed for every patient or medical condition.
6.3 Risks and Limitations of Telehealth
Patients understand that telehealth has certain limitations, including:
- The inability to perform a complete hands-on physical examination.
- Technical interruptions, connectivity failures, or equipment problems.
- Potential delays in diagnosis or treatment when additional clinical evaluation is required.
- Privacy or cybersecurity risks associated with electronic communications.
- The possibility that laboratory testing, diagnostic imaging, specialist evaluation, or in-person treatment may be necessary.
A healthcare provider may recommend or require in-person care when telehealth is insufficient or clinically inappropriate.
6.4 Patient Responsibilities During Telehealth Visits
Patients agree to:
- Provide accurate and complete medical information.
- Disclose their physical location at the time of the appointment.
- Use appropriate technology and a reasonably reliable internet connection.
- Participate from a private location whenever possible.
- Inform the provider of any technical difficulties affecting the consultation.
- Ask questions about medical recommendations they do not understand.
- Seek appropriate in-person or emergency care when advised or medically necessary.
6.5 Consent to Telehealth Treatment
Before receiving telehealth services, patients will be informed about the use of telehealth and asked to provide consent in accordance with applicable law.
Consent may be obtained verbally, electronically, or in writing, depending on the requirements of the patient’s state and the circumstances of care.
FemmeKare or the treating healthcare provider will document telehealth consent as required by applicable law.
Patients may ask questions about telehealth services, their risks, limitations, and available alternatives before agreeing to receive care.
Consent to telehealth does not guarantee a diagnosis, prescription, particular treatment, or clinical outcome.
6.6 Right to Decline or Withdraw Telehealth Consent
Patients may decline telehealth services or withdraw their consent to receive future care through telehealth, subject to applicable law.
Declining or withdrawing telehealth consent does not automatically entitle a patient to a refund for healthcare services already provided.
Any applicable refund or cancellation request will be handled according to FemmeKare’s Refund Policy and applicable law.
Patients who prefer in-person care may seek services from an appropriate healthcare provider. FemmeKare does not guarantee the availability of in-person appointments.
6.7 Privacy and Confidentiality
FemmeKare handles protected health information in accordance with applicable federal and state privacy laws, including HIPAA where applicable.
Patients should take reasonable precautions to protect their privacy during telehealth consultations.
Information concerning the use, disclosure, and protection of patient health information is available in FemmeKare’s Privacy Policy and HIPAA Notice of Privacy Practices.
6.8 Emergency Medical Situations
FemmeKare is not an emergency medical service.
Patients experiencing a medical or psychiatric emergency should call 911 or visit the nearest emergency department.
Telehealth appointments, website forms, emails, and routine support communications should not be used for emergency medical assistance.
6.9 Separate Telehealth Informed Consent
Patients may be required to review and provide a separate Telehealth Informed Consent before receiving healthcare services.
Any consent required by applicable federal or state law must be obtained and documented through an appropriate consent process.
Acceptance of these Terms & Conditions does not replace any separate informed consent required by law.
7. Patient Location and Provider Licensure
Patients must accurately disclose their physical location at the time of each telehealth appointment.
Healthcare providers must be licensed, registered, or otherwise legally authorized to provide healthcare in the jurisdiction where the patient is physically located during the consultation.
FemmeKare may be unable to provide or continue a service if:
- The patient’s physical location cannot be verified.
- The assigned provider is not authorized to practice in the patient’s location.
- State or federal law limits the requested service.
- Telehealth is not clinically appropriate.
- Additional requirements for the requested treatment cannot be satisfied.
Patients who are traveling or planning to attend an appointment from another state should notify FemmeKare before their scheduled visit.
8. Patient Responsibilities
Patients are responsible for providing accurate and complete information relevant to their healthcare.
This may include:
- Current symptoms and health concerns.
- Medical and mental health history.
- Current medications and treatments.
- Medication allergies.
- Previous diagnoses and treatments.
- Relevant substance use history.
- Pregnancy status, where clinically relevant.
- Relevant laboratory results or medical records.
Patients must inform their healthcare provider when their condition changes or previously supplied information becomes inaccurate.
Patients should follow agreed treatment instructions and seek clarification whenever they do not understand a diagnosis, prescribed medication, follow-up recommendation, or treatment plan.
Patients must not intentionally provide false or misleading medical information to obtain medications, services, or prescriptions.
9. Appointments and Scheduling
Appointments are subject to provider availability, licensure, clinical appropriateness, and applicable law.
Same-day appointments may be available for certain services but are not guaranteed.
FemmeKare may need to reschedule or cancel appointments because of:
- Provider availability.
- Licensing restrictions.
- Clinical considerations.
- Technical difficulties.
- Emergencies.
- Operational circumstances.
- Other legally or clinically necessary reasons.
Patients should attend appointments at the scheduled time and provide timely notice if they cannot attend.
Patients who arrive more than 15 minutes after the scheduled start time may be considered late. The provider may be unable to complete the appointment if insufficient clinical time remains.
A late arrival that cannot reasonably be accommodated may be treated as a missed appointment under the Patient No-Show and Late Cancellation Policy.
Appointment cancellation, rescheduling, refund, and no-show rules are described in Section 13 and the relevant FemmeKare policies.
10. Self-Pay Services
FemmeKare operates on a self-pay basis.
FemmeKare does not accept health insurance as payment for its services and does not submit insurance claims on behalf of patients.
Patients are responsible for the fees associated with the appointments or services they purchase.
Payment is generally required at the time of booking unless another arrangement is expressly disclosed before purchase.
FemmeKare does not guarantee reimbursement from health insurance plans.
Patients who choose to request reimbursement independently are responsible for determining whether their insurance arrangements provide any applicable reimbursement.
Separate services offered by independent pharmacies, laboratories, or other healthcare providers may involve additional charges.
Eligible uninsured or self-pay patients retain their rights under applicable federal and state healthcare billing laws.
11. No Subscriptions, Memberships, or Automatic Renewals
FemmeKare does not offer memberships, recurring subscriptions, or automatically renewing billing plans.
Patients pay for individual appointments or services.
Booking or paying for one appointment does not authorize FemmeKare to automatically charge patients for future appointments or services.
Any additional purchase requires appropriate disclosure and authorization.
Patients are not automatically enrolled in recurring billing arrangements by using FemmeKare services.
12. Payments and Billing Responsibilities
By submitting payment information, patients confirm that they are authorized to use the selected payment method and authorize SDKare LLC or its authorized payment processor to charge the amount disclosed for the selected service.
Patients are responsible for:
- Reviewing service prices before booking.
- Providing accurate billing information.
- Using an authorized payment method.
- Paying applicable service fees.
- Reviewing disclosed cancellation and no-show conditions.
- Reporting suspected billing errors promptly.
Additional fees for late cancellations or no-shows apply only as described in Section 13 and the corresponding FemmeKare policies.
FemmeKare will not intentionally impose charges that have not been properly disclosed or authorized.
Cancellation and no-show fees are assessed separately and are not deducted from refunds.
Patients should review the Payment Policy for Clients for additional information regarding payment authorization, failed payments, refunds, and billing disputes.
13. Cancellations, No-Shows, Rescheduling, and Refunds
FemmeKare maintains appointment cancellation and rescheduling policies to support appointment availability and appropriate use of healthcare providers’ scheduled clinical time.
The following provisions summarize the applicable rules.
13.1 Cancellations Made at Least 24 Hours in Advance
Patients who cancel an appointment at least 24 hours before the scheduled start time are generally eligible for a full refund of the applicable appointment service fee.
This is subject to any separately disclosed and legally permissible non-refundable booking condition.
No late-cancellation or no-show fee applies to appointments properly canceled at least 24 hours before their scheduled start time.
13.2 Cancellations Made Less Than 24 Hours in Advance
Appointments canceled less than 24 hours before their scheduled start time are considered late cancellations.
These appointments are non-refundable under FemmeKare’s standard cancellation terms.
Patients may request rescheduling, and the original appointment payment will be applied toward the rescheduled consultation in accordance with the applicable policies.
A fee waiver does not independently create a right to a refund.
13.3 First Late Cancellation
A patient’s first qualifying late cancellation is exempt from the $25 late-cancellation fee.
The following conditions apply:
- No additional $25 late-cancellation fee is charged.
- The original appointment payment is non-refundable.
- The patient may reschedule without an additional late-cancellation fee.
- The original payment will be applied toward the rescheduled appointment.
This waiver remains subject to the special exceptions described below.
13.4 Subsequent Late Cancellations
Any qualifying late cancellation after the first late cancellation is subject to a $25 fee.
The original appointment payment remains non-refundable and will be applied toward the rescheduled appointment.
The applicable $25 fee must be paid before rescheduling, unless already paid.
The fee is charged separately and is not deducted from a refund.
13.5 First No-Show
A patient’s first qualifying no-show is eligible for one complimentary rescheduling opportunity.
No $25 no-show fee applies to the first qualifying occurrence.
The original appointment payment will be applied toward the rescheduled visit.
The complimentary rescheduling opportunity does not independently entitle the patient to a refund.
13.6 Subsequent No-Shows
Any qualifying no-show after the first is generally subject to a $25 no-show fee.
The applicable fee must be paid before rescheduling, unless already paid or an applicable exception applies.
No-show fees are charged separately and are not deducted from refunds.
13.7 Same-Day Initial Appointments
Appointments booked by new patients for an initial consultation scheduled on the same calendar day are non-refundable when canceled or missed by the patient.
The following conditions apply:
- Patients may request rescheduling instead of receiving a refund.
- One complimentary rescheduling opportunity is available.
- The original appointment payment will be applied toward the rescheduled visit.
- The first qualifying late cancellation does not incur an additional $25 fee.
- Subsequent qualifying late cancellations may incur a $25 charge, payable before rescheduling.
- No additional $25 no-show fee will be imposed when the original non-refundable payment for that same-day initial appointment has been retained.
This special same-day appointment condition applies only to new patients scheduling their initial consultations.
Existing patients remain subject to the standard cancellation and refund provisions.
13.8 Separate First-Occurrence Waivers
FemmeKare tracks no-shows and late cancellations separately.
Patients generally receive:
- One first-occurrence no-show fee waiver.
- One first-occurrence late-cancellation fee waiver.
These waivers apply independently, except where the special rules below apply.
No-Show and Late Cancellation Within 24 Hours
If a patient has a no-show and a late cancellation within 24 hours of each other, only one first-occurrence waiver may be applied to those two events.
The waiver applies to whichever event occurred first.
The second event is subject to the applicable $25 fee, even if it would otherwise qualify for a separate first-occurrence waiver.
The restriction against charging an additional no-show fee on a retained, non-refundable same-day initial appointment payment remains applicable.
Late Cancellation of a Rescheduled Initial Appointment
If a patient misses their initial appointment without notice, receives complimentary rescheduling, and subsequently cancels the rescheduled appointment less than 24 hours before the scheduled start time, a $25 late-cancellation fee applies.
This specific exception applies even if the patient has not previously used their first-occurrence late-cancellation waiver.
The original appointment payment remains non-refundable and may be applied toward the next rescheduled visit.
The $25 fee must be paid before another rescheduling request can be completed, unless already paid.
13.9 Three Consecutive Cancellations
Patients who cancel appointments three consecutive times may have their scheduling arrangements reviewed, regardless of whether the cancellations occurred within or outside the 24-hour cancellation window.
Following this review, FemmeKare may establish additional conditions for future scheduling, provided those conditions are properly communicated and legally permissible.
Any additional charge must be disclosed to the patient before it applies.
This provision does not independently authorize an unspecified cancellation fee.
13.10 Completed Appointments and Provider Cancellations
Appointment and consultation fees are generally non-refundable once the healthcare service has been provided, except where otherwise required by applicable law.
If FemmeKare or the treating healthcare provider cancels an appointment before the purchased service is delivered, the patient will not be charged a no-show or late-cancellation fee for that cancellation.
The patient may be offered rescheduling or, where appropriate or legally required, a refund.
Patient cancellation fees do not apply to cancellations initiated by FemmeKare or the healthcare provider.
13.11 Applicable Policies
The complete cancellation, no-show, rescheduling, and refund conditions are described in FemmeKare’s:
- Refund Policy.
- Patient No-Show and Late Cancellation Policy.
- Payment Policy for Clients.
All charges and non-refundable terms remain subject to applicable law and the conditions disclosed before purchase.
14. Prescriptions and Medication Management
Prescriptions are issued only when a licensed healthcare provider determines that medication is clinically appropriate and legally permitted.
Payment for a consultation does not guarantee that a prescription will be issued.
Prescribing decisions may consider:
- Diagnosis and symptoms.
- Medical history.
- Current medications.
- Potential drug interactions.
- Allergies or contraindications.
- Previous treatments.
- Clinical risks.
- Applicable federal and state laws.
- Provider scope of practice.
A healthcare provider may decline to prescribe medication, recommend an alternative treatment, or require further clinical evaluation.
Patients must follow the instructions provided by their treating healthcare professional and disclose relevant medication information.
15. Controlled Substance Prescribing
Controlled substances are subject to additional federal and state prescribing requirements and FemmeKare’s internal prescribing policies.
As of the Last Updated date of these Terms, applicable federal DEA telemedicine flexibilities permitting qualifying remote prescribing of certain controlled medications have been extended through December 31, 2026.
These federal flexibilities do not guarantee eligibility for controlled-substance prescriptions and do not override applicable state laws, professional standards, or FemmeKare prescribing restrictions.
A provider may require additional clinical evaluation, medical records, prescription monitoring program review, laboratory testing, an in-person examination, specialist assessment, or follow-up care where appropriate.
15.1 28-Day Controlled Substance Rule
FemmeKare, as a service operated by SDKare LLC, follows a 28-day prescribing policy for all controlled substance medications.
Under this policy:
- Early refills of controlled substance medications are not permitted within 28 days following the previous prescription’s pharmacy fill date.
- Requests to switch to another controlled medication within the same therapeutic category are also restricted during that 28-day period.
- The restriction applies regardless of the reason for the early refill or medication change, including lost, damaged, or stolen medication.
- The 28-day period begins on the date the previous prescription was filled by the pharmacy, not the date on which the prescription was written.
- Scheduling or paying for a consultation does not guarantee that an early refill, replacement prescription, or medication change will be approved.
This is an internal prescribing restriction established to support patient safety and consistent controlled-substance management. It does not represent a universal 28-day requirement imposed by federal law.
15.2 Clinical Concerns During the 28-Day Period
Patients experiencing medication-related concerns, side effects, or changes in their medical condition should seek timely medical advice from an appropriately licensed healthcare professional.
Under the confirmed FemmeKare policy, such concerns do not automatically authorize an early controlled-substance refill or a medication change within the same therapeutic category.
Patients experiencing a medical emergency should call 911 or visit the nearest emergency department.
FemmeKare is not an emergency medical service and does not provide emergency controlled-substance replacements.
This policy does not limit a healthcare provider’s obligation to respond appropriately to medical safety concerns or comply with applicable law.
15.3 Legal and Clinical Requirements
Controlled-substance prescriptions remain subject to applicable federal and state law, provider authorization, professional standards, and pharmacy dispensing requirements.
FemmeKare does not guarantee that every patient, provider, medication, or clinical condition will qualify for controlled-substance prescribing through telehealth.
Additional requirements are described in FemmeKare’s Telehealth and DEA Prescribing Policy.
16. Prescriptions, Pharmacies, and Medication Fulfillment
FemmeKare providers may issue prescriptions when clinically appropriate.
How patients obtain prescribed medications depends on the service and the applicable purchase terms.
16.1 Most Healthcare Services
For services other than weight-loss programs with separately included medication delivery, the provider may issue a prescription, and the patient purchases the medication through an appropriate pharmacy.
Unless expressly included in the purchased service, medication costs are separate from consultation fees.
FemmeKare does not itself dispense, fill, or ship medication for these services.
16.2 Weight-Loss Services
Where offered, FemmeKare weight-loss services may include different purchasing arrangements.
Depending on the service selected, patients may be offered:
- A consultation or program in which a prescription may be issued when clinically appropriate, with the patient purchasing medication separately.
- A program in which medication delivery is expressly included in the disclosed purchase price.
Available options, included services, and pricing must be disclosed before purchase.
A prescription or medication delivery is not guaranteed unless the applicable service and clinical requirements are satisfied.
Where medication delivery is included in a purchased service, the applicable purchase terms and any service-specific fulfillment or refund conditions will apply, subject to applicable law.
16.3 Independent Pharmacy Operations
FemmeKare does not control independent pharmacy operations, including:
- Medication inventory.
- Pharmacy pricing.
- Dispensing decisions.
- Processing times.
- Medication availability.
- Manufacturer supply.
- Pharmacy-specific policies.
Receiving a prescription does not guarantee that a pharmacy will dispense the medication.
Patients should contact the applicable pharmacy about availability or fulfillment questions.
17. Privacy and Protected Health Information
FemmeKare handles protected health information in accordance with applicable federal and state privacy laws, including HIPAA where applicable.
Patients should review FemmeKare’s:
- Privacy Policy.
- HIPAA Notice of Privacy Practices.
The Notice of Privacy Practices explains how protected health information may be used or disclosed, patient privacy rights, applicable legal duties, and procedures for raising privacy concerns.
The handling of patient information may also be subject to applicable state confidentiality laws and other legal protections.
18. Privacy During Telehealth Appointments
Patients should take reasonable steps to protect their privacy during virtual consultations.
Where possible, patients should:
- Attend appointments from a private location.
- Use a personal or otherwise trusted device.
- Use a secure internet connection.
- Avoid unsecured public Wi-Fi.
- Use headphones if others may overhear the appointment.
- Protect account passwords and device access.
- Prevent unauthorized individuals from accessing consultations or patient information.
No electronic communication system can eliminate every privacy or cybersecurity risk.
Patients should notify FemmeKare if they become aware of a suspected privacy or security concern involving their account or communications.
19. Technology Requirements
Patients are responsible for having technology reasonably capable of supporting a telehealth consultation.
This may include:
- Reliable internet access.
- A compatible computer, tablet, or smartphone.
- Camera access where required.
- A functioning microphone and speakers.
- Supported software or browser access.
Technical interruptions may occasionally delay or prevent a scheduled appointment.
If a telehealth consultation cannot be completed because of a technical issue, FemmeKare will review the circumstances to determine an appropriate next step.
Technical problems attributable to FemmeKare’s systems or the healthcare provider’s inability to conduct the visit will not be treated as a patient no-show.
Technical difficulties arising solely from a patient’s equipment or internet connection do not automatically create a right to a refund or fee waiver.
Applicable resolutions are governed by the Refund Policy and Patient No-Show and Late Cancellation Policy.
20. Electronic Communications
By providing a telephone number or email address, patients agree to receive communications reasonably necessary to administer their services, subject to applicable communication and consent laws.
Such communications may include:
- Appointment confirmations.
- Appointment reminders.
- Scheduling changes.
- Billing and payment communications.
- Account notifications.
- Patient Support responses.
- Administrative notices.
Marketing communications, where used, are subject to applicable consent, disclosure, and opt-out requirements.
Patients are responsible for maintaining accurate contact information.
Patients should be aware that ordinary email and text messaging may not provide the same privacy protections as secure healthcare communication systems.
21. Emergency Medical Care
FemmeKare is not an emergency medical service.
Patients should not use website forms, scheduled appointments, email, text messages, or routine Patient Support channels to seek emergency medical assistance.
For a medical or psychiatric emergency, call 911 or visit the nearest emergency department.
Patients in the United States experiencing a mental health crisis or suicidal thoughts may call or text 988 for crisis support.
Patients experiencing severe medication reactions, overdose symptoms, or other urgent medical concerns should seek appropriate emergency medical attention.
Routine telehealth scheduling and messaging channels are not substitutes for emergency care.
22. Educational Content and Medical Disclaimer
Information provided on the FemmeKare website is intended for general educational and informational purposes.
Website content does not independently constitute:
- Individualized medical advice.
- A medical diagnosis.
- A prescription.
- A personalized treatment recommendation.
- A substitute for appropriate professional healthcare.
Patients should not use general website information as the sole basis for starting, stopping, or changing prescribed medication.
Individualized clinical recommendations require appropriate evaluation by a qualified healthcare professional.
23. Account Security
If FemmeKare provides a patient account or online portal, patients are responsible for protecting their account credentials.
Patients agree to:
- Maintain secure passwords.
- Keep login information confidential.
- Avoid permitting unauthorized account access.
- Notify FemmeKare about suspected unauthorized account activity.
- Keep contact and account information accurate.
FemmeKare may temporarily restrict account access when reasonably necessary to investigate suspected misuse or security concerns.
Such actions will be subject to applicable legal and patient-care obligations.
24. Prohibited Conduct
Patients and website users must not use FemmeKare services to:
- Engage in unlawful activities.
- Misrepresent their identity.
- Intentionally provide false medical or billing information.
- Fraudulently obtain healthcare services or prescriptions.
- Access another patient’s private information without authorization.
- Interfere with website or system security.
- Introduce malware or other harmful technology.
- Scrape or extract protected content without authorization.
- Threaten, harass, or abuse healthcare providers, support personnel, or other users.
- Use FemmeKare content for unauthorized commercial purposes.
FemmeKare may restrict or terminate access where reasonably necessary to protect patients, providers, personnel, systems, or legal compliance.
Any restriction affecting ongoing healthcare services will be managed in accordance with applicable professional and continuity-of-care obligations.
25. Intellectual Property
Unless otherwise stated, original content, branding, graphics, design elements, software, and other website materials used by FemmeKare are owned by or licensed to SDKare LLC or other authorized rights holders.
These materials are protected by applicable intellectual property laws.
Website content may be used for personal, non-commercial purposes unless otherwise permitted.
Users may not reproduce, distribute, modify, republish, sell, or commercially exploit protected materials without appropriate authorization.
Nothing in this section limits uses permitted under applicable law.
26. Third-Party Services
FemmeKare may use third-party providers to support functions such as:
- Payment processing.
- Appointment scheduling.
- Electronic communications.
- Technology infrastructure.
- Pharmacy services.
- Other authorized operational services.
Third-party services may be governed by their own terms, privacy notices, and operating procedures.
FemmeKare is not responsible for the independent clinical or commercial decisions of third parties except to the extent responsibility is imposed by applicable law or an applicable agreement.
Nothing in this section limits SDKare LLC’s legal obligations concerning vendors, contractors, or business associates that handle protected health information on its behalf.
27. Service Availability
FemmeKare does not guarantee continuous availability of:
- A particular healthcare provider.
- A specific appointment time.
- A particular clinical service.
- A particular treatment.
- A medication or prescription.
- A specific pharmacy.
- Website or platform access.
Service availability may depend on operational capacity, provider licensure, patient location, clinical requirements, and applicable law.
FemmeKare may modify, suspend, or discontinue services or website features when reasonably necessary.
Changes affecting previously purchased services or ongoing patient care will be handled according to applicable contractual, legal, and professional obligations.
28. No Guarantee of Clinical Results
Healthcare outcomes vary between patients.
Neither FemmeKare nor its healthcare providers guarantee that a treatment, medication, therapy, or other healthcare service will produce a particular result.
Treatment recommendations are based on professional clinical judgment, information available during evaluation, and applicable standards of care.
The absence of a particular treatment outcome does not, by itself, establish eligibility for a refund of a completed consultation.
This section does not limit any legal rights relating to negligent care or other legally actionable conduct.
29. Website and Technology Availability Disclaimer
FemmeKare seeks to maintain reliable website and digital services but does not guarantee that non-clinical technology systems will operate continuously without interruption, delay, or error.
To the extent permitted by applicable law, website and non-clinical technology services are provided on an “as available” basis.
This provision does not reduce the professional responsibilities of licensed healthcare providers.
Where a technology issue prevents a purchased appointment from being provided, the matter will be addressed under the applicable Refund Policy and legal requirements.
30. Limitation of Liability
To the maximum extent permitted by applicable law, SDKare LLC will not be liable for indirect, incidental, special, or consequential damages arising solely from use of, or inability to access, FemmeKare’s website or non-clinical technology services.
Nothing in these Terms is intended to:
- Waive rights that cannot legally be waived.
- Exclude liability that cannot legally be excluded.
- Limit the professional duties of licensed healthcare providers.
- Exclude liability for conduct where exclusion is prohibited by law.
- Override applicable healthcare, privacy, or consumer protection laws.
- Eliminate legally required refunds or other remedies.
Any applicable limitation will be interpreted consistently with federal and state law.
31. Changes to Services or Terms
SDKare LLC may update these Terms to reflect changes in FemmeKare’s services, scheduling practices, payment procedures, technology, or legal requirements.
The Last Updated date will identify the most recent approved revision.
Material changes will be communicated, and consent obtained where required by applicable law.
Changes will not retroactively impose additional fees or payment obligations on completed transactions unless permitted by law and appropriately authorized.
Appointment cancellation, refund, and payment conditions applicable to a particular transaction are determined by the terms disclosed in connection with that transaction, subject to applicable law.
32. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law provisions, except where mandatory provisions of another applicable jurisdiction or federal law control.
Healthcare services are also governed by the laws and professional requirements applicable where the patient is physically located and where the treating provider is authorized to practice.
Nothing in this section limits mandatory patient or consumer protections available under applicable law.
33. Relationship to Other FemmeKare Policies
These Terms should be read together with FemmeKare’s:
- Privacy Policy.
- HIPAA Notice of Privacy Practices.
- HIPAA Privacy and Security Policy, where applicable.
- Refund Policy.
- Payment Policy for Clients.
- Patient No-Show and Late Cancellation Policy.
- Telehealth Informed Consent.
- Telehealth and DEA Prescribing Policy.
The Refund Policy governs refund eligibility and processing.
The Payment Policy for Clients explains patient payment responsibilities, billing, and payment disputes.
The Patient No-Show and Late Cancellation Policy provides detailed appointment cancellation, first-occurrence waiver, rescheduling, and fee requirements.
The Telehealth and DEA Prescribing Policy addresses applicable prescribing requirements, including the 28-day controlled substance rule.
Where another policy addresses a specific subject in greater detail, that policy will apply to that subject to the extent permitted by applicable law.
Nothing in these Terms or the incorporated policies limits rights or remedies that cannot lawfully be waived.
